Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "user") and MedQgulf ("MedQgulf", "we", "us", "our") governing your access to and use of the MedQgulf website, applications, question banks, mock exams, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. The Service is intended for licensed or aspiring medical professionals. By using the Service you represent and warrant that you meet these requirements and that the information you provide is accurate and current.

2. Accounts and security

  • You are responsible for all activity that occurs under your account.
  • You must keep your credentials confidential and never share, sell, transfer, or license your account.
  • One account per person. Concurrent use of a single account from multiple devices or locations may result in suspension.
  • You must notify us immediately of any unauthorised access or suspected breach of security.
  • We may refuse, suspend, or terminate accounts at our discretion, including for suspected abuse, fraud, or violation of these Terms.

3. Subscriptions, payments, and refunds

  • Access to paid features requires a valid subscription. Prices, plan durations, and included features are described at checkout and may change at any time for future purchases.
  • Payment is due in advance for the full plan term. All fees are non-refundable except where required by mandatory local law or expressly stated in a specific promotion.
  • Any "pass guarantee" or extended-access benefit applies only under the specific written conditions published for that plan and is void in cases of misuse, fraud, sharing, or breach of these Terms.
  • You are responsible for all applicable taxes, currency conversion fees, and bank charges.
  • Chargebacks initiated without first contacting us may result in immediate termination and forfeiture of remaining access.

4. Acceptable use

You agree not to, and not to permit any third party to:

  • Copy, reproduce, download, scrape, cache, redistribute, publish, sell, sublicense, or otherwise exploit any part of the Service or its content.
  • Share account credentials, subscription access, questions, answers, rationales, mock exams, slideshows, images, or any other content with any other person or platform.
  • Use automated tools, bots, crawlers, or scripts to access the Service or extract content.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service.
  • Attempt to bypass, disable, or interfere with security, authentication, rate-limiting, watermarking, or usage-monitoring features.
  • Upload or transmit malware, harmful code, or content that is unlawful, defamatory, infringing, harassing, or otherwise objectionable.
  • Use the Service to violate any law, regulation, or third-party right, or in connection with actual patient care or clinical decision-making.
  • Misrepresent your identity, credentials, or professional status.

Violation may result in immediate termination without refund and may be reported to relevant authorities.

5. Intellectual property

The Service and all content — including questions, answers, rationales, mock exams, slideshows, images, text, graphics, logos, trademarks, software, and design — are owned by or licensed to MedQgulf and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own individual exam preparation only. No other rights are granted. All rights not expressly granted are reserved by MedQgulf.

6. User feedback

Any feedback, suggestions, corrections, or ideas you submit about the Service are non-confidential and may be used by MedQgulf for any purpose, without restriction and without compensation to you. You grant us a perpetual, worldwide, royalty-free, sublicensable, transferable licence to use such feedback.

7. Third-party services

The Service may integrate with or link to third-party services (for example, authentication, payment, email, or analytics providers). We are not responsible for the availability, content, or practices of any third party, and your use of those services is governed by their own terms and policies.

8. Educational disclaimer

The Service provides exam-preparation material for educational purposes only. It is not medical advice and must not be used for clinical decision-making, diagnosis, or treatment. MedQgulf is an independent educational platform and is not affiliated with, endorsed by, or sponsored by DHA, MOH, DHCC, HAAD, SCFHS, QCHP, OMSB, or any other regulatory, licensing, or governmental body. References to these bodies are used descriptively for exam identification only. No pass, licensure, employment, or examination outcome is promised or guaranteed except as expressly stated in the written conditions of a specific plan.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE OR ITS CONTENT WILL MEET YOUR REQUIREMENTS, BE ACCURATE, RELIABLE, COMPLETE, UP TO DATE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR SOLE RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDQGULF, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, EXAM OUTCOMES, LICENSURE OUTCOMES, EMPLOYMENT OUTCOMES, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE — WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO MEDQGULF IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless MedQgulf and its owners, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms or any applicable law, (c) your infringement of any right of any third party, or (d) any content or data you submit to the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the Service ceases immediately, unused portions of paid plans are forfeited (except where prohibited by law), and provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

13. Modifications to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time without liability. We may also update these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, may provide notice through the Service or by email at our discretion. Your continued use of the Service after any change constitutes acceptance of the updated Terms.

14. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Dubai, UAE for the resolution of any such disputes, unless otherwise required by mandatory local law.

15. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and MedQgulf regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.
  • No waiver. Our failure to enforce any right or provision shall not be a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms without our prior written consent; we may assign them freely.
  • Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.
